I am closing oin less than 10days, all the "stuff"(garbage,furnishings,etc.) still in/at home..

We re closing on our home in less than 10 days on an estate sale, the garbage, furnishings, dumpster, car, etc are still on the property, I don't want to buy that stuff, and I don't want to deal with disposal/sale, if heirs don't get it out when I do my final walk thru, what recourse do I have?  Sale is obviously as is, but does that pertain to their "stuff"? And IF I must deal with it, can I ask for the title to the car?(get something back for my efforts?)

Was there an understanding that the home would be cleaned out prior to closing? Or do they consider the state of the home the 'as is' part?

If you want the home to be empty, and it's a condition of the sale, you can't close because once you close there is no 'carrot and stick' to compel them to do the work. Trust me, we learned that one the hard way.

The only other approach would be to have the sellers escrow the funds necessary to clean the property up, then you would pay to do the work after closing and the escrow would pay the contractor. But you would have to know what it's going to cost to clean it up before you get to closing.

Have your agent 'remind' their agent the house needs to be empty as condition of closing and see it that works.
